Remo Stoffel's complaint against the "Rundschau" is rejected

The Federal Court has rejected the complaints of real estate entrepreneur Remo Stoffel against the broadcast of the SRF program "Rundschau" entitled "Escalation in Vals". Stoffel criticized that viewers could not have formed their own opinion due to misleading references.

The Rundschau broadcast of March 9, 2016, criticized by Stoffel, dealt with the question of whether the Vals hotel and thermal spa had been sold to the company Stoffel Partizipationen for too low a price. Opponents of the sale, the "Group of Concerned Citizens of Vals", had had an expert opinion drawn up that came to this conclusion.

In its ruling published on Thursday, the Federal Supreme Court states that the editors had critically examined the author of the report and the conclusions therein.

It was recognizable to the viewers that the question of the correct market value could not be judged conclusively. Remo Stoffel also had the opportunity to correct "any imperfections" in the interview following the film clip, as the Federal Court writes.

On the other hand, the Lausanne judges described as problematic the fact that an agreement on content had been made prior to the interview, which the interviewer had not adhered to. For example, an earlier investigation against Stoffel on suspicion of tax fraud was discussed despite an agreement to the contrary. (SDA)
